GARBARSKA 18 local 11, LUBLIN 20-340 Poland, Company ID: 9462749866, VAT: 9462749866, Regon number: 540851352, assigned for the purposes of Polish VAT payment (hereinafter referred to as “Delamark” or “we”), the operator of the online store www.delamark.eu, declares that all personal data (hereinafter referred to as “data”) is treated as strictly confidential and is processed in accordance with applicable legal regulations on personal data protection.
Protecting personal data is a priority for us. That is why we pay special attention to personal data and its protection. In these Personal Data Processing Principles (hereinafter referred to as the “Principles”), you will find information on what personal data we collect, the legal basis for processing it, the purposes for which we use it, how long we retain it, and who we may share it with. The Principles also inform you of the rights data subjects have regarding the processing of their personal data.
1. What personal data do we process?
When using our online store services, we process various types of data.
1.1. When purchasing
The most common data provided by the customer is collected through the order form for a product or service on our website. This usually includes the data necessary for concluding and performing a sales contract.
This data is required to fulfill the order and can be divided into:
1. Identification data, i.e., first and last name, and in the case of a purchase for a company — REGON and NIP (Tax Identification Number);
2. Contact data, including email address, postal address, billing address, phone number, bank details, and payment details;
3. Data generated in connection with the concluded contract, specific purchased products, service costs, and customer segments.
1.2. When registering
If you want to benefit from having a customer account, you need to register on our website or enter into a membership agreement to join the so-called Delamark Club. The customer account is protected by a password chosen by you, which we do not have access to. In case of loss, we cannot retrieve or generate a new password upon request.
Within the account, users have unlimited access to their personal data and the ability to edit it. They can view the history of completed orders, purchased products, and incomplete orders. Through the customer account, users can also save payment card data, manage newsletter subscriptions, and use the wishlist feature.
Delamark Club is also part of the customer account, providing access to a range of benefits. More information can be found in the relevant terms and conditions. If a customer does not wish to create an account, they may purchase without registration. The membership agreement in the Delamark Club can be terminated according to the applicable terms and conditions.
For Club members, we process the following data:
1. Identification data (first and last name, and in case of company purchase — REGON and NIP);
2. Contact data (email address, postal address, billing address, phone number, bank and payment details);
3. Demographic data based on user settings and behavior online, including gender, date of birth, and preferred language;
4. Login data (username and password; we do not have access to the actual password);
5. Contract-related data (purchased products, value of services provided, and customer segmentation).
1.3. When receiving marketing information
You may receive marketing information from us regarding products similar to those purchased. You can opt out of receiving this information at any time by using the unsubscribe link at the bottom of each email. Customers with accounts may also opt out via their account settings.
Unsubscribing from marketing communication is free of charge.
Registered customers may also receive marketing via SMS or push notifications. Push notifications with marketing content may also be sent through Facebook or Messenger. In this case, the data processing is subject to the respective social network’s privacy policy. You may opt out of these channels at any time.
We process the following data of recipients:
1. Identification data, especially first name;
2. Contact data, such as email address, and for Club members, also phone number;
3. Demographic data based on user settings and behavior, including gender and language preference.
1.4. Website visitors and content creators
We collect information such as IP address, browser and language settings, visited pages, date and time of visit, and clicks for web navigation, which help tailor content and offers.
When visiting our site, cookies are stored and later read in your browser and device, as explained in a separate section of these Terms.
We also process behavioral data, IP address, browser details (e.g., resolution, OS version, language settings), and link it to social networks via plugins (e.g., “Share” buttons). Personalized offers and ads may be shown on social media as a result.
Users can interact through reviews, comments, and content creation without a customer account. Content may display names and surnames as entered in the form. Users are responsible for what they post and should avoid including personal information they do not wish to make public.
Our websites may contain links to other websites managed by third parties, which process data under their own policies. We are not responsible for their content, products, or services.
1.5. When contacting our hotline or social media
If you contact customer support by phone or email, we may process call recordings and email messages. When contacting via our website or social media profiles, data processing is governed by the relevant social network’s privacy policy.
1.6. When setting up availability notifications
If an item is out of stock, we monitor its availability and send an email notification when it is back. The email address provided is used solely for this purpose.
1.7. When leaving a review on external platforms
After receiving a product, you may be asked to rate it or your satisfaction level on selected review platforms. Participation is optional. For such reviews, we process:
1. Contact data (email address used for the review invitation);
2. Contract-related data (purchased products).
1.8. When participating in contests
We organize customer contests via our website or social media. Full rules are available [link referenced in original]. Winner details may be published. Social media interactions are governed by that network’s data policy.
We process the following data for contest participants:
1. Identification data (first and last name);
2. Contact data (social profile, email, and, in case of winning, address and phone number).
1.9. For user testing or event participation
If participating in product testing, we may process:
1. Identification data (name and surname);
2. Contact data (email and phone number);
3. Camera recording (user image).
We also run campaigns and events where we may process:
1. Identification data (name, surname, possibly REGON and NIP);
2. Contact data (email and phone number).
For each campaign, we will specify which data is processed.
2. For what purposes do we process personal data?
2.1. Purchase of goods and services
Most often, personal data is processed to fulfill sales contracts — processing orders placed via the website, app, or hotline, and delivering products. Email and phone are used for order confirmations, invoices, status updates, and if necessary, direct contact.
2.2. Customer account
For registered users, data is processed to fulfill the Club Delamark membership agreement and offer related benefits.
2.3. Promotional offers
We send marketing information about products similar to those previously purchased. You can unsubscribe at any time using the link in the message footer. Registered users may receive such messages via SMS, app push notifications, Facebook, or Messenger. Social media messages follow that platform’s privacy rules. Once you unsubscribe, we will no longer use your data for these communications.
Unsubscribing is free.
2.4. Content Customization and Creation, Website Improvement
We want to tailor content for our users and recommend products that might interest them. For this reason, we use the collected personal data to personalize content and offers on our websites. Displayed marketing offers may be selected based on other user information obtained at certain points in time, such as contact and demographic data, favorite products, and other data related to the use of our websites. However, we do not perform fully automated processing that would have legal consequences for the user.
We process data on user behavior on our websites, which allows us to gather information to continuously improve our websites and make them as user-friendly as possible. We may also process your personal data to generate various statistics, for example, to monitor visits or measure advertising effectiveness, as well as to test new features of our websites or mobile applications. Data on user behavior online is also important for preventing any attacks on our websites.
On our websites, you may also create certain content. If you decide to write a review of purchased products, we will process personal data to handle and display such a review. If you participate in discussions on our blog articles and post comments, we process personal data to handle and display such comments.
2.5. Customer Service and Communication
We constantly strive to improve the services provided by our customer support and, to respond quickly to inquiries and provide effective service, we need your personal data to efficiently process your requests or resolve any issues related to the purchase agreement or Club Delamark membership agreement. In case of phone contact, the conversation will be recorded after prior notification to continually improve the quality of our services.
We also use collected personal data to contact you and tailor communications to your individual needs. For example, we may contact you by phone, email, via a mobile app, or other means to remind you about items in your cart or help you complete your order. Additionally, to inform you about the current status of your inquiry, order, or complaint, or to obtain further information from you. We may also notify you in this way about the need to perform an action required to maintain the active status of your customer account.
2.6. Product Availability Notification
If a user selects the availability monitoring feature for an out-of-stock product, we will send a message to the provided email address when the product is back in stock.
2.7. Consumer Contests
If you participate in a contest organized by us, we process personal data for the purpose of conducting the contest and, in the case of winning, for the public announcement of results and contacting the winner.
2.8. Service Improvement
We use your personal data to continuously improve our services and systems, including adding new features. We also process your personal data to make informed decisions using aggregated analysis and business analytics based on our legitimate interests, the freedom of economic activity, and the necessity to improve the services we provide to gain a competitive advantage.
However, to ensure proper protection of your rights and interests, we use personal data that has been maximally anonymized for this purpose.
2.9. Protection, Security, and Dispute Resolution
We may also process personal data to ensure the protection and security of our customers and systems, to exercise our rights and legal claims, to detect and prevent fraud, to resolve disputes, or to enforce our agreements. Additionally, we may process personal data for potential inspections carried out by government authorities.
3. What are the legal bases for our processing of personal data?
We process personal data in various volumes and for various purposes, as detailed in Articles 1 and 2 above:
a) Without your consent based on a contract, legal obligation, or our legitimate interest;
b) Based on your consent.
The types of processing we may perform without your consent depend on the specific processing purpose and the data subject’s relationship with our company — whether they are simply a website visitor, making a purchase, or registering with us. However, personal data may also be processed if the data subject is the recipient of the ordered product or service, contacts us, or visits our point of sale.
3.1. Conclusion of Purchase Contract and Club Delamark Membership Agreement
When purchasing or placing an order with our company, an offer is made to conclude a purchase contract, which is concluded upon acceptance of the offer by us through the shipment of the ordered goods. To perform such a purchase contract or other contracts concerning goods or services, most of the personal data entered via the order form is necessary. Specific data processed in such cases is listed in Article 1, points 1 and 5.
When registering on our website, we process personal data based on the execution of a Club Delamark membership agreement for the purpose of managing the customer account. The agreement forming the basis for processing is established when the customer account is created. After the account is closed, i.e., the membership agreement terminated according to applicable regulations, we cease processing personal data for this purpose. Specific data processed in such cases is listed in Article 1, point 2.
In the case of registration in a test club, we process personal data based on the execution of the test club membership agreement for fulfilling related obligations. The agreement is concluded at the time of registration in the test club and regulated by the test club rules. Upon termination of the agreement according to relevant provisions, we cease processing personal data provided for this purpose. Specific personal data processed is listed in Article 1, point 9.
3.2. Fulfillment of Legal Obligations
We must also comply with legal obligations set forth in applicable laws. Processing personal data based on such obligations does not require the data subject’s consent. On this legal basis, we process identification and contact data as well as order data. Specific data processed in such cases is listed in Article 1, point 1.
3.3. Consent
To send commercial information by email, we may process personal data based on consent provided by the user. Based on the given consent, we process it unless it is processed based on legitimate interest or the execution of a club membership agreement. You may withdraw your consent and opt out of receiving commercial information at any time. Specific data processed in such cases is listed in Article 1, point 3.
We also require consent when planning to publish product reviews, blog comments, enable availability monitoring, or during user testing or other campaigns. In these cases, consent may also be withdrawn at any time. Specific data processed in these cases is listed in Article 1, points 4, 7, and 10.
3.4. Legitimate Interest
We also process personal data based on legitimate interest to improve and tailor services, determine if an order was successfully fulfilled, and more effectively advertise offered products and services. This applies particularly to data specified in Article 1, points 4 and 5.
Based on our legitimate interest in direct marketing, we may also send commercial information about products similar to those purchased in our stores, provided no objection to such processing has been raised. Registered customers receive commercial information based on fulfilling the club membership agreement. Specific data processed is listed in Article 1, point 3.
Our legitimate interest also includes protecting legal claims, internal accounting, and controlling the proper provision of our services. In this case, we process all categories of personal data listed in Article 1.
Our legitimate interest also involves sending requests for purchase reviews made via selected opinion portals or evaluations of consumer contests organized by us. Specific data processed is listed in Article 1, points 8 and 9.
Processing personal data based on legitimate interest also occurs during visits to our sales points equipped with monitoring systems for property protection. You may object to such processing at any time. Specific data processed is listed in Article 1, point 6.
4. To whom do we disclose personal data?
In most cases, we process personal data for our own purposes as controllers, meaning we determine the above-mentioned purposes of personal data collection, processing methods, and their proper implementation.
We disclose personal data to our partners only when necessary to perform a purchase contract, e.g., for payment or delivery; for executing the club membership contract; based on legitimate interest; or if you have previously consented to data transfer.
We also disclose personal data to our processors, who comply with legal data protection requirements. These processors process personal data according to our instructions without infringing the rights of data subjects. With your consent, we may also transfer personal data to social networks or marketing tool operators to display targeted advertising on other websites.
4.1 Categories of Recipients
We may disclose personal data to the following organizations:
- Companies and data processors of the Club Delamark group based on execution of the purchase contract or membership agreement for internal process and procedure implementation;
- Companies providing payment services to process payments for placed orders;
- Carriers for delivery of ordered goods or services and handling complaints, including withdrawal from purchase contracts;
- Product suppliers or service centers in connection with complaints about ordered products or services;
- Partners involved in sending commercial information bound by confidentiality obligations and prohibited from using personal data for other purposes;
- Marketing tool operators assisting in personalizing offers and content;
- Social networks if you contact us via them or share content using social plugins;
- Customer support contact service operators or external call centers when necessary;
- Partners conducting customer satisfaction surveys;
- Technology providers and cloud service operators;
- Legal or financial representatives, courts for processing trade documents, debt collection, or other purposes arising from legal obligations;
- Government authorities enforcing our rights (e.g., police).
If third parties use disclosed personal data in their legitimate interests, we bear no responsibility for such processing. Such processing is solely subject to the data processing principles of the concerned company or person.
4.2 Data Transfer Outside the EU
When transferring personal data to our processors, we may also transfer data to third countries outside the European Union that do not ensure an adequate level of data protection. Such transfer will only occur if the processor commits to comply with the European Commission’s standard contractual clauses, available here.
5. How long do we process personal data and how is it protected?
5.1 Processing period
We process personal data primarily for the duration of our contract, in this case, the purchase agreement or the Club Delamark membership agreement. We are obliged to process such personal data necessary to fulfill our obligations, whether these obligations arise from the concluded contract or from generally applicable legal regulations, for the period specified or required by relevant legal provisions. For example, in the case of accounting documents issued by us, as the administrator, we are required to keep the data for at least 10 years from the date of issuance.
We process personal data primarily during the term of our contract, i.e., the purchase agreement or membership agreement. Additionally, we also process personal data for the period necessary to properly fulfill all our obligations arising from the contract and applicable laws. For example, for accounting documents issued by us, we must retain data for at least 10 years.
For handling user inquiries and ensuring the highest quality of customer service, we process personal data from the start of the contractual relationship and for 1 year after the warranty period on the purchased product to resolve any potential disputes.
If a data subject contacts us via our customer support service, we retain personal data related to that contact for 2 years, including recorded call logs.
If consent is given for receiving commercial information, such consent is valid for 4 years or until withdrawn. Consent to notifications about product availability is valid until the notification is sent, up to a maximum of 1 year, or until withdrawn. Consent provided by submitting a product review is valid for 6 years or until withdrawn. Consent given by submitting a comment on a blog article is valid for 2 years or until withdrawn. In the case of participation in user testing or other campaigns organized by us, and providing consent for data processing, personal data is processed for 1 year or until withdrawal, including any video or audio recordings.
In other cases, the data processing period is determined by the purpose of processing or as set by applicable data protection laws. After these periods expire, personal data will be automatically deleted.
5.2 Security
Collected and processed personal data is transmitted in encrypted form using SSL (Secure Socket Layer) encryption. This system ensures the security of user data when the browser interacts with our server. We protect our websites and other systems with appropriate technical and organizational measures against loss, destruction, unauthorized access, alteration, or modification of personal data.
We continuously improve these security measures and require our data processors to demonstrate compliance with GDPR.
When registering a client, account access is possible only after entering a chosen password. We do not have access to user passwords as they are stored in an encrypted form that neither the user nor we can decrypt.
We kindly ask you not to share your login credentials with third parties. After completing a transaction in your client account, we recommend logging out, especially if the device is shared with others. We are not responsible for unauthorized use of your password unless caused directly by our actions.
6. How do we use cookies?
We also use cookies to ensure our websites function properly and to make our offers personalized, interesting, and user-friendly. Using cookies requires your web browser to support them. Our websites can function without cookies but with very limited functionality, restricting the use of some key features.

Practically, we use these cookies, for example, to:

7. What rights does the data subject have and how can they exercise them?
Just as we have rights and obligations regarding data processing, data subjects also have rights they can exercise. These include:
7.1 Right of access
The data subject has the right to request free information about the processing of their personal data — what data we process, for what purpose, for how long, from where we received the data, and to whom we transfer it. You can also request the processed data in a structured, machine-readable format. After verifying your identity, we will provide a copy. Simply send a request by email with the subject line “(Inspector, personal data)” to the Data Protection Officer (hereinafter “Inspector”) at info@delamark.eu.
7.2 Right to rectification
If processed personal data is found to be incorrect or incomplete, the data subject can request correction. We will correct or supplement data without undue delay. Send your request by email with the subject “(Inspector, personal data)” to info@delamark.eu.
7.3 Right to erasure
In certain cases, you may exercise the right to delete processed personal data. We will immediately delete or anonymize your personal data unless retention is required by law (e.g., order fulfillment) or necessary to protect our legitimate interests. Data will also be deleted if no longer needed for the purpose or if retention is unlawful. Requests can be sent to info@delamark.eu with the subject “(Inspector, personal data).”
7.4 Right to restriction of processing
In some cases, you may request restriction of processing, meaning your data will not be further processed for a limited period. Requests can be sent to info@delamark.eu.
7.5 Right to data portability
You have the right to receive any personal data you provided, processed based on your consent, in a structured, machine-readable format. Requests can be sent to info@delamark.eu.
7.6 Right to object
You may object to processing based on our legitimate interests. For marketing purposes, processing will cease immediately. In other cases, we will reconsider our interests and your reasons before deciding. Objections can be sent to info@delamark.eu.
7.7 Right to lodge a complaint
Exercising these rights does not limit the right to file a complaint with the supervisory authority, especially if you believe we process data unlawfully. The supervisory authority is the Office of the General Inspector for Personal Data Protection, located at ul. Stawki 2, 00-193 Warsaw.

Your request will be processed promptly, no later than 30 days. In exceptional cases, particularly complex ones, this period may be extended by two months.
