General Terms and Conditions of Sale

1. Introductory Provisions

1.1 These General Terms and Conditions of Sale govern the relationship between DELAMARK LLC, registered at UL. GARBARSKA 18 local 11, LUBLIN 20-340 Poland, Company ID: 9462749866, VAT: 9462749866, REGON number: 540851352, as the seller managing the online store at delamark.eu, and the customer who concludes a purchase agreement with the company.

1.2 The company treats all customers equally and offers them the same benefits, regardless of whether they are consumers. Therefore, these General Terms and Conditions of Sale apply to all customers.

1.3 These General Terms and Conditions of Sale primarily govern the purchase of goods through the company’s online store.

2. Conclusion of the Purchase Agreement

2.1 The customer concludes a remote purchase agreement with the company through the online store.

2.2 When placing an order online or via the customer service hotline, the customer is making a purchase offer. The order is valid for 7 days, and the company will confirm receipt via email. The final purchase agreement is concluded when the company accepts the preliminary agreement by shipping the ordered goods. The company will notify the customer by email when the goods are shipped.

2.3 The company supplies goods only in quantities suitable for personal consumption. In certain cases (especially during sales or promotions), the company reserves the right to limit the maximum quantity of items per order.

2.4 To place an order in the online store, click the “Buy Now” button. The terms and conditions along with order data are stored for 6 years. If the customer provides incorrect data, they can correct it through the order form or in their personal account.

3. Withdrawal from the Agreement without Giving Reasons

3.1 By law, the customer may withdraw from a remote agreement within 14 days of receiving the goods without giving any reason. However, the company extends this right to 90 days from the date of delivery.

3.2 To exercise this right, the customer must notify the company within the stated time by writing to info@delamark.eu or calling +48 536 347 103.

3.3 Upon withdrawal, the customer will be refunded the cost of the goods. If the withdrawal occurs within 14 days of delivery, the customer will also be refunded the cost of the cheapest delivery method. For later withdrawals, only the cost of the goods is refunded. Refunds will be made promptly, no later than 14 days from the withdrawal date. By law, the company may withhold the refund until the returned item is received. Unless agreed otherwise, the refund will be made using the same payment method as the original transaction.

3.4 The customer must return the goods immediately, no later than 14 days from the withdrawal date, to:

If a gift was included with the order, it must also be returned. If not returned, the seller may withhold the refund until it is received. The customer bears the return shipping costs.

3.5 Please note that under the law, the customer is liable for any decrease in the value of goods resulting from handling beyond what is necessary to assess their nature, characteristics, and functionality (e.g., using perfume after trying it on). Withdrawal is not permitted for personalized items (e.g., engraved packaging), custom-made goods, or items unsealed for hygiene reasons (e.g., opened cosmetics). The company also reserves the right to deny cancellation of gift-wrapping or eco-packaging services once those services have been performed.

4. Complaints

4.1 If a defect is found upon delivery, the company may offer compensation via a voucher. The customer may request a replacement. If repair or replacement is impossible or impractical, the customer may request a discount or — in the case of a serious defect — withdraw from the purchase agreement. These rights apply even if the defect is discovered later.

4.2 The company is liable for defects that appear within two years of delivery or before the product’s expiration date.

4.3 Products are considered defective if they lack usual or declared characteristics, are unfit for their intended purpose, do not comply with legal standards, or are delivered in the wrong quantity. Allergic reactions or personal sensitivities are not grounds for complaint. Gifts or free products not included in the order are also excluded from complaints. Product images in the store are for illustration purposes only and may differ (e.g., packaging changes by the manufacturer).

Include a complaint form (can be written informally). You may also email your complaint, including order number, full name, and proof of payment if possible. Describe the defect and your preferred solution.

4.5 The company will notify the customer by email (or phone) about the complaint’s status.

4.6 Complaints are processed promptly, typically within 30 days. If not, the customer may withdraw from the purchase agreement. The customer must cooperate to ensure this timeline.

4.7 If the complaint is accepted, the company covers return shipping costs.

5. Payment and Delivery Options

5.1 Customers may choose from available payment and delivery options. These options and their costs are communicated before the order is finalized. If paying online by card, the charge occurs at the time of transaction.

5.2 Available payment and delivery methods, and their costs, are listed during checkout.

5.3 Delivery times are estimates based on carrier information. Maximum delivery time from the moment of payment is 10 days)

5.4 The company may offer free shipping in certain cases.

6. Miscellaneous Provisions

The company may offer various discounts, gift certificates, and other vouchers. Terms of use are provided for each case. Unless otherwise stated, each discount or voucher can be used once. Only one coupon of the same type can be used per order. Discounts cannot be combined unless stated. If a gift certificate value exceeds the order total, the balance is not refunded or transferred.

7. Sample Shipments

7.1 The company may offer free product samples to selected customers. These may include fragrances or cosmetics as per the current store offer.

7.2 Sample shipments are for promotional purposes only and do not constitute part of a sales agreement. Therefore, sample defects do not justify a complaint.

7.3 The company may contact customers to assess their satisfaction with the product. By requesting a sample, the customer agrees to such contact.

8.1 According to the sales registration law, the seller must issue an invoice.
